128. 19862 The Presidency of the U.S. Government.

The framers of the U.S. Constitution intended to assign more power to Congress than to the presidency. Bearing in mind that Americans had waged revolution against monarchy, the framers intended to put a check on presidential power and gave Congress the power to override a presidential veto and to impeach and remove a president. However, the history of U.S. politics reveals that the presidency is a constraining force on Congress and presidents have frequently used the constitutional power to veto legislation passed by Congress.

129. 72 The Power of the Supreme Court.

This paper discusses the Supreme Court and its role. Currently, the Supreme Court is composed of nine justices, including eight associate justices and one chief justice. Also called "the Court of Last Resort," the Supreme Court was established in 1790 with six justices. It is the highest federal court in the United States. Each Supreme Court justice is appointed for life by the President of the United States and confirmed by the Senate. The most important function of the Supreme Court is to review decisions by the intermediate appellate courts. These include the United States Courts of Appeal that are divided into 13 separate federal circuits. The Chief Justice appoints each of the associate justices to oversee one or more of the various circuits. The Justices must exercise considerable discretion in deciding which cases to hear, since more than 6,500 civil and criminal cases are filed in the Supreme Court each year from the various state and federal courts. The Supreme Court also has "original jurisdiction" in a very small number of cases arising out of disputes between states or between a state and the federal government.

The focus of this paper is the system of checks and balances of the United States. The Constitution of a democratic government provides for the control of powers through a system of Checks and Balances. This system refers to constitutional controls of the separate branches of government, i.e., executive, legislative and judicial, over one another to insure that not one will have more power over the two others (Grolier Inc 2000). It is commonly believed that the policy provided by the checks and balances of the Federal Constitution of the United States makes it the best-known and most democratic system in the world today (Grolier).
